Terms and Conditions

1. Booking Information:
1.1 The ‘Hirer’ means the person signing the booking form for ‘Hire of equipment’.
1.2 ‘Eat Sleep Dream Repeat’ is a trading name of Not Another Mummy Ltd and refers to Alison and Mark Perry.
1.3 Provisional bookings for parties booked more than 14 days in advance will be held for 48 hours, parties booked within 14 days of the party date will require immediate full payment. Party dates not confirmed within these times will be re-released.
1.4 A non-refundable booking deposit of £100 is required to confirm the booking in addition to a completed Booking Form. 
1.5 Final balances, paid by card via Stripe, are required no less than 14 days prior to the party.
1.6 The final numbers and choices must be confirmed at least 14 days prior to the date of the booking. Any booking reductions after this time will still be charged for at the previous rate, with no refunds due.
1.7 The Hirer must disclose the property type and access to the venue at the time of booking. In the event that access is limited or difficult it is at Eat Sleep Dream Repeat’s discretion whether the booking is accepted. Eat Sleep Dream Repeat will accept no liability or responsibility if upon arrival for set-up, it’s discovered that access is restricted or difficult and it means the booking cannot go ahead. No refunds will be given if the booking cannot go ahead because of difficult access which has not been disclosed by The Hirer at the time of booking.
1.8 The Hirer is responsible for providing Eat Sleep Dream Repeat staff with all relevant medical/dietary information for all the children attending the party. Eat Sleep Dream Repeat takes no responsibility for allergies (including skin, food, materials etc.) that were not disclosed by The Hirer at the time of booking. Eat Sleep Dream Repeat is not responsible at any point, for the welfare of the children at the parties, which remains the full responsibility of The Hirer. 
1.9 Some products used may contain traces of nuts or may have been made in a factory that handles nuts. Please carefully check all ingredients before use.
1.10 The Hirer is responsible for ensuring the accuracy of the information given to Eat Sleep Dream Repeat and to pass over such information in sufficient time for Eat Sleep Dream Repeat to perform the contract safely and without risk, within 14 days of the event occurring, to avoid last minute disappointment.
1.11 The Hirer is responsible for ensuring adequate indoor space is available for the equipment to be set up and arranged. The space needed for one A-frame tent and mattress is 90cm (wide) x 160cm (length) cm. The breakfast trays are 56 x 36cm and are usually placed in front of each bed. The large lace tent is 200cm x 200cm. Eat Sleep Dream Repeat will not refund in full or in part the monies paid in the event that adequate space is not available to set up the equipment that The Hirer has confirmed on the Booking Form.
1.12 Eat Sleep Dream Repeat reserves the right to make any changes to the services as is deemed necessary by Eat Sleep Dream Repeat without notice to The Hirer. If the service is less than originally requested an appropriate refund will be made to The Hirer.
1.13 The Hirer is liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use of any Eat Sleep Dream Repeat equipment. No real candles or fire pits allowed within the proximity of Eat Sleep Dream Repeat equipment.
1.14 Smoking is not permitted in the proximity of any Eat Sleep Dream Repeat equipment. If smoking is detected The Hirer will forfeit the full security deposit.
1.15 It is The Hirer’s responsibility to ensure that the children are supervised at all times. Eat Sleep Dream Repeat will charge the hirer for the cost of any damage to any property caused by any breach of this clause. This includes food or drink spillages that damage equipment or renders them unwashable. 
1.16 It is The Hirer’s responsibility to ensure the children comply with all reasonable instructions from Eat Sleep Dream Repeat employees to ensure the safety of the attendees and other persons present. Eat Sleep Dream Repeat may suspend the event if you are in breach of this clause. If damage does occur under supervision The Hirer will be charged at Eat Sleep Dream Repeat’s discretion.
1.17 Eat Sleep Dream Repeat accept no liability or responsibility to The Hirer for any damages, costs, losses, claims, expenses, demands and proceedings including property of The Hirer, or any third party and their guests, or any consequential loss in these regards.
1.18 Eat Sleep Dream Repeat shall use all reasonable endeavour to provide the services in accordance with the contract and shall perform the services with reasonable skill, care and diligence.
1.19 Eat Sleep Dream Repeat shall process all data in accordance with the Data Protection Act 2018.  
1.20 A checklist of the rental items and any additional items can be provided by Eat Sleep Dream Repeat if requested by The Hirer. It is The Hirer’s responsibility to return all the items in perfect condition the next day.
1.21 Accessories for each theme are subject to change and may vary slightly from the images seen on Eat Sleep Dream Repeat’s website and social media platforms.
1.22 The hire fee is for one night only, however extra nights can be arranged with prior arrangement.
1.23 Delivery, set up and collection is free for locations of up to a 7 mile radius of Bromley. A surcharge is payable for locations further away.
1.24 The Hirer or another responsible adult must be present at the agreed time for Eat Sleep Dream Repeat staff to set up and style your party.
1.25 The Hirer must advise of any parking restrictions, difficult access roads or narrow roads at least 14 days before the booking. Eat Sleep Dream Repeat reserves the right to cancel the booking due to the above and no refunds will be given.
1.26 If The Hirer’s road requires a parking permit or charge The Hirer must provide such permit or advise of the charge in advance. The Hirer must inform Eat Sleep Dream Repeat of the above at least 14 days before the party.
1.27 Eat Sleep Dream Repeat will endeavour to arrive at the location at the agreed time, however on occasions there may be circumstances beyond Eat Sleep Dream Repeat’s control that may mean later arrival. These may include reasons such as (but not limited to) unpredicted road traffic, road closures etc. Eat Sleep Dream Repeat will contact The Hirer to advise we are running late if it is possible and safe to do so.

2. Supervision:
2.1 The Hirer is responsible for the care and safety of all the children and should ensure that all parent/guardians are aware that Eat Sleep Dream Repeat are not responsible for the care and safety of the children.
2.2 The Hirer will be required to take responsibility for all children that have been left by their parent/guardian.
2.3 We recommend that The Hirer takes contact telephone numbers of the children attending if their parent/guardian is not staying, at the same time as clarifying any medical/allergic conditions at least 14 days in advance of the event.

3. Cancellation (by The Hirer):
In the unfortunate event the party is cancelled the following refund policy will be applied:
3.1 Cancellation of a booking up to 14 days prior to the party will forfeit the booking deposit paid.
3.2 Cancellation of a booking between and including 13 and 7 days prior to the party will be refunded 50% of the total monies paid.
3.3 Cancellation of a booking within 7 days of the party will unfortunately forfeit all monies paid.

4. Cancellation (by Eat Sleep Dream Repeat):
4.1 Eat Sleep Dream Repeat reserves the right to cancel the booking at any time for any reason. In the unlikely event of a cancellation, Eat Sleep Dream Repeat will give as much notice as possible.
4.2 Upon any such cancellation Eat Sleep Dream Repeat will refund to The Hirer any monies paid to Eat Sleep Dream Repeat in respect of the booking – including the non-refundable Booking Fee, but Eat Sleep Dream Repeat will not be liable to pay any compensation to The Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation.
4.3 Eat Sleep Dream Repeat reserves the right to terminate the booking without notice if there is a breach of these Terms and conditions.

5. Liability
5.1 Nothing in these terms shall limit or exclude the liability of Eat Sleep Dream Repeat, which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by Eat Sleep Dream Repeat’s negligence or fraudulent misrepresentation.
5.2 Subject to the above Eat Sleep Dream Repeat shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for The Hirer’s breach of the contract.
5.3 Subject to the above clauses Eat Sleep Dream Repeat’s aggregate liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by The Hirer.
5.4 This contract is governed and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England.
5.5 No information included in this booking form will be disclosed to any third party.
5.6 It is the responsibility of The Hirer to inform guests accordingly of the above terms and conditions.
5.7 Eat Sleep Dream Repeat have suitable public liability insurance and take the upmost care to ensure the safety of all party guests at all times.
5.8 Eat Sleep Dream Repeat use high quality products and follow strict hygiene routines.
5.9 Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter.
5.10 All persons using Eat Sleep Dream Repeat equipment do so at their own risk and it is The Hirer who is responsible/liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use.
5.11 This information is given for the safety of all people attending a party hosted by Eat Sleep Dream Repeat and it is the sole responsibility of The Hirer to ensure that they are understood and adhered to by all party guests invited.

By acknowledging the Terms & Conditions above, you hereby confirm that you have read, understood and accepted the terms of the goods and services provided by Eat Sleep Dream Repeat.
